Terms of Service

These Terms of Service ("Terms") govern your use of the SnowServ mobile and web applications and related services (the "Service"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What SnowServ Is

SnowServ operates a technology platform that connects customers seeking snow-removal services with independent providers who offer them. SnowServ is a marketplace and payment facilitator; it does not itself perform snow removal. Providers are independent contractors, not employees or agents of SnowServ.

2. Eligibility & Accounts

You must be at least 18 years old to use the Service. You are responsible for the accuracy of your account information and for keeping your login credentials secure. You are responsible for activity that occurs under your account.

3. Orders, Payments & Cancellations

  • Pricing is shown before you confirm an order and may vary by service area and by snow conditions ("storm pricing"), which is displayed up front.
  • Authorization hold. When you place an order, we place a temporary authorization hold on your payment method. Your card is charged only when a provider starts the job.
  • Cancellation. You may cancel before a provider starts the job; because no charge has occurred, the hold is released and you are not charged. Cancellations after work has begun may be charged for work performed.
  • Refunds are handled as described in the app. Payments are processed by Stripe, subject to Stripe’s terms.

4. Provider Terms

If you use the Service as a provider, you agree that you are an independent contractor responsible for your own equipment, taxes, and compliance with law, including carrying any required insurance. SnowServ retains a platform commission and pays you the remainder of the job price on a rolling basis, as described in the app and in your provider agreement. You agree not to divert SnowServ customers off-platform.

5. Acceptable Use

You agree not to misuse the Service, including by: violating any law; providing false information; interfering with or disrupting the Service; attempting to gain unauthorized access; or using the Service to harass, harm, or defraud others.

6. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SnowServ does not warrant that the Service will be uninterrupted or error-free, or guarantee the acts, omissions, quality, timing, or safety of services performed by independent providers.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SnowServ AND ITS OWNERS, OFFICERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING FROM THE ACTS OR OMISSIONS OF INDEPENDENT PROVIDERS OR CUSTOMERS. SnowServ’s total liability for any claim relating to the Service will not exceed the amount you paid to SnowServ for the order giving rise to the claim.

8. Indemnification

You agree to indemnify and hold harmless SnowServ from any claims, damages, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service, your violation of these Terms, or your violation of any law or the rights of a third party.

9. Changes to the Service or Terms

We may modify or discontinue the Service, and may update these Terms, at any time. We will post the updated Terms here and revise the "Last updated" date. Continued use after changes means you accept the updated Terms.

10. Governing Law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in New York for any dispute not subject to arbitration or small-claims resolution.
